These terms of use are an addendum to the terms of use of the entire system. You can read the systems' terms of here.
In this agreement:
Supplier – Site123.com
Designers Network – A system that allows anyone to upload design templates according to predefined criteria, and allows anyone to use those templates according to predefined criteria.
Customer – a registered user in the "Designers Network".
User – anyone who uses the templates or other items in the "Designers Network".
1. Commercial co-operation
Since the supplier developed the following system:
A system that operates over the internet, and provides every "customer" the possibility to upload design templates according to predefined criteria and allows every "user" to use those templates according to predefined criteria as well.
And since the customer, the supplier, and the user, are willing to co-operate in providing services based on the system that was developed by the supplier, the following co-operation principles are agreed upon in this agreement.
2. Payments and commissions

The customer (deisgner) will receive 100% of the cost he set for the template for every user that buys that template.

The user will see a listing price consisting of the price set by the customer plus 10% commission which belongs to the system.

The customer may request the money after accumulating $200 or more in his account.

If the customer does not accumulate $200 or more, or if he fails to provide an invoice to the supplier, the supplier may refuse payment until these conditions are met.

A payment will be made only if the customer provided an invoice to the supplier. Customers that can not produce invoices, may receive their money in other ways, but only if the supplier approves it.

You will not receive payment in the following cases:

If the user cancelled the order after a few days.

If the transaction was not approved by the credit card company or by any other method of payment.

The transaction content was erroneous and eventually the user did not order the template.
3. Terms of use for the user who uses the templates

Every user who purchases a template can use it in one site only.

The user will not sell or transfer the template to any other users who did not pay for it through the system.

The user is entitled to receive the template's design files including the original files that enable him to edit it.

The user may use the Logo and the template files in other areas of his business including areas not present on the internet, such as fliers, or TV commercials.

The user may edit the template he purchased or its' source files which came with it without any limitations.
4. Terms of use for the supplier who uses the templates.

The supplier may sell the templates by any mean or method of its choice, but must pay the customer the price of the template that was set by the customer.

The supplier may delete templates he does not like even after he approved them.
5. Terms of use for the customer who designed the templates
· The customer will not advertise his template in other places.
· In the event that the customer decides not to continue with this program he will not delete his uploaded templates from the supplier's system. For these templates the supplier will continue to send payment to the customer.
· The customer takes full responsibility for any picture, or object inserted into the template, and he acknowledges that the picture or object is copyrighted for multiple uses.
· The customer acknowledges that he can use the photos and files provided by the supplier.
· In case the customer is unable to collect his accumulated money due to death or any other cause, the supplier may use his own judgment in disbursing the money to the customers next of kin or a charity organization. The supplier will not keep the money.
· The customer will not be able to prevent anyone from downloading his templates, only the supplier will decide how to market and sell the templates.
· The customer will not be involved in any matter between the supplier and the user.
· The customer assures that all personal information he provided in the suppliers' system are correct, and he is committed to update the information if needed.
· The customer will compensate the supplier immediately for any damage or cost the supplier sustained (including lawyer fees and court fees) as a result of any lawsuit or legal action related to the style, essence, or context of the information provided by the customer.
